
Our Policies – Terms & Conditions
In order to rent equipment from Smoky Mountain H2o Sports, LLC, the following terms & conditions must be agreed upon by renter and drivers:
Damage Deposit and Renter Responsibility Information:
Hourly and Overnight Tritoons and Pontoons have a $500 damage deposit, and Waverunners have a $400 damage deposit. The damage deposit is due at check in and can either be done as a hold on a card or cash. We release the damage deposit once the motorized equipment is returned with no damage upon final inspection. If your reservation results in a cancellation due to not providing a damage deposit, there will not be a refund.
While the All-Inclusive option does not require a damage deposit, renter agrees to pay for any and all damages/repair costs and loss of rental revenue due to damages sustained during the rental of equipment from Smoky Mountain H2o Sports, LLC upon final inspection.
Any damage to rental equipment or other property damaged in the course of your rental from H2o Sports will be the renter’s responsibility and will be paid for before leaving the Smoky Mountain H2o Sports premises and no trip insurance or rental insurance is provided by Smoky Mountain H2o Sports. Repair costs are the responsibility of the renter.
Boater’s and Driver’s License Requirement:
Renter AND anyone driving motorized equipment rented should arrive 30 minutes prior to reservation time and must have a valid United States driver’s license and will have the physical copy present at check in to be eligible to operate equipment. A valid internation driver’s license in English is also accepted from internation visitors. A boater’s license is not required to rent or drive rental equipment.
A temporary boater’s license issued by Smoky Mountain H2o Sports, LLC is required for all motorized equipment rentals. This temporary license is issued once anyone driving motorized equipment watches the boat and/or jet ski safety video available on smokymountainh2osports.com or on site at time of check at our location. A quick quiz is given to all drivers at check-in to confirm the video has been viewed.
Fuel/Gas costs:
The All Inclusive option is for up to 1 tank of gas on the boat rented from Smoky Mountain H2o Sports the day and time of scheduled rental and does not include gratuity or towable items that may be added on in addition to the boat rental costs. This rental cost also does not include damage or repair costs determined needed upon equipment return and inspection.
For hourly and overnight motorized equipment rentals, the cost of fuel is a separate charge and the renter agrees to pay for the fuel used during reservation time. The cost of fuel will be charged during your return of the boat at the check out window. If you forget to stop by the checkout window and leave without paying for the cost of fuel, your card will be automatically charged and a receipt will be emailed to you. Please be sure provide an email that you can receive communications and receipts from Smoky Mountain H2O Sports.
Equipment Capacity and Guidelines:
Smoky Mountain H2o Sports recommends the following capacity guidelines for all rental equipment and reserves the right to require changes to rental equipment reservations to accommodate staying within these capacity limits:
*75 HP FISH/Ski Pontoon – up to 8 people and no more than 1200 lbs
*60 & 115 HP Pontoons – up to 10 people and no more than 1500 lbs
*150, 200, 250 HP Tritoons – up to 12 people and no more than 1800 lbs
*300 HP Elite Tritoon – up to 14 people and no more than 2100 lbs
*Waverunners – up to 3 people and no more than 450 lbs
*Kayaks & Paddleboards for 1 person only and no more than 200 lbs
*Tandem or Double Kayaks for up to 2 people and no more than 400 lbs
Waverunner/Jet Ski Guidelines:
Waverunner rentals are restricted to no more than 3 waverunners for any family group or party during the time of your reservation due to our liability policy. If more than 3 jet skis or waverunners are rented during your reservation time, the renter forfeits the damage deposit for those additional items. Smoky Mountain H2o Sports, LLC liability policy applies even if individuals that are in the same family, group or party creates their own reservation under a different name on a separate reservation. Smoky Mountain H2o Sports, LLC reserves the right to cancel any reservations and retain rental reservation deposits for reservations beyond this limit.
In order to offer prompt assistance as needed, Smoky Mountain h2o Sports, LLC advises renters of waverunners/jet skis to stay in the area of the mouth of Muddy Creek and the Dandridge Bridge and that going outside of this area could result in a $100 charge if H2o Sports personnel has to come out to rescue the jet ski
Miscellaneous instructions:
Smoky Mountain H2O Sports is a family-oriented company and asks all renters to agree to keep alcohol to a minimum. You also agree that all motorized equipment will have a designated driver that won’t consume any alcohol at all times throughout the duration of the rental.
Our dog policy states that your dog must be under 20 lbs and a non-shedding breed. If your dog is a service animal, you are required to present your dogs registration card verifying it as a service animal. Otherwise, if it is over 20 lbs it will not be permitted on any of our rental equipment. As part of our dog policy, if you bring a dog on the boat and it does shed there will be a $50 cleaning fee to remove the dog hair. You are agreeing to the $50 cleaning fee if it should be necessary.
While food and beverage are welcome on our rental equipment, grills create a fire hazard and are NOT permitted on any Smoky Mountain H2O Sports equipment. This also includes charcoal and flammable grilling accessories.
Arrive & check in 30 mins before your reserved start time. You acknowledge and agree to be here 30 minutes early. If you are not going to be on time or running late, you will need to call the reservation office so it can be notated on your reservation. You acknowledge and agree if renter and drivers are not 30 minutes early that there won’t be any adjustments to your time if you don’t get started by your reservation start time.
When possible, we are glad to extend your return time if you would like more time. Unless you make other arrangements with the reservation office prior to your return time, be back to the dock as scheduled in your reservation. You are subject to twice the per minute rental rate charge for every minute you are late returning. The late fee charge will be communicated to you at the checkout window. If you don’t stop by checkout window before leaving, we will call you and then apply the charge either to your card on file or against the damage deposit that is made at check in.
Cancellation and Weather Policy:
A renter may cancel any time prior to 48 hours of your reservation and receive a full refund. Cancellations done in the 25-48 hour mark will have a $50.00 cancellation charge and you will only receive a 50% refund of the deposit you paid to make the reservation. Cancellations done in 24 hours or less of your reservation will result in no refund. Our weather policy states if there is a persistent rain that won’t let up or a storm on the day of your reservation at our location then you can cancel under the weather policy and receive a refund or you can reschedule. The weather policy will only be in effect on the day of your reservation. We don’t include sprinkling or overcast in the weather policy. Overnight rentals are included in the cancellation policy but NOT included in the weather policy.
